The discussion and voting on this opinion took place behind closed doors, with the chairman of the commission, the socialist Alexandra Leitão, advancing in the end that it was failed with the votes against the PS, the abstention of the PSD and the vote in favor of Chega.

Last week, and after having previously agreed not to vote on the initial opinion, Chega announced that it would ask the Commission for Transparency and Statute of Deputies to make a new assessment of the situation of Jamila Madeira, who accumulated functions in parliament and at REN.

In the request rejected today, Chega asked the commission to pronounce “on the compatibility or not, on the part of the deputy Jamila Madeira, of the exercise of the position of deputy with a professional activity of consultant, part-time, in REN Serviços”.

“And, if so, what are the consequences of this incompatibility, under the terms of the Statute of Deputies and other applicable legislation, given that the said deputy was in the said situation from 2015 until the end of 2022”, added the document sent to Lusa by the party.

On January 17, the Transparency Commission clarified that the process of investigating Jamila Madeira’s impediment situation was ended a week earlier due to the fact that the Socialist deputy has been exclusively in parliament since the 1st of this month.

According to Alexandra Leitão explained that day, the law does not provide for the replacement of funds received in cases like Jamila Madeira.

“From the moment the lady in question informs us that from January 1, 2023 it would be in exclusivity, that is, that it is only here in parliament, in fact, even if the opinion later comes to be approved, there was no other consequence because the consequence would be to notify her to cease the situation, which she had already informed us that ‘motu proprio’ [de livre vontade] was going to do”, defended the president of the commission.

Asked then whether the matter would be closed, Alexandra Leitão was adamant: “On the part of the Transparency Commission, with the data we have today, yes”.

Regarding the postponement of the vote on the draft opinion on December 20, Alexandra Leitão indicated that the issue was raised “initially by the PS Parliamentary Group” but the decision to postpone it was taken “by agreement in the commission” after news that pointed out that this postponement would have been potestative.

Today, during the period of the meeting that was open to journalists, the chair of the commission referred precisely to the minutes of that day’s meeting, which would have generated “some strangeness”, with the services of parliament having returned to listen to the audio of that meeting.

For this reason, the correction of the minutes of that day will be distributed to the deputies, which “will be the rigorous transcription of the audio”, specifically on the moment of the postponement of the vote on the draft opinion prepared by the PSD that pointed to an “impediment in the cumulative exercise” of the two positions, but which never came to be voted on.

Pointing out that “there is a different abstract understanding of what the use of the potestative is” for the postponement, Alexandra Leitão explained that when she does not see an obstacle from any of the deputies, what she “understands” is that there is “an agreement, even if not by vote.

After this case, the president of the 14th commission decided that from now on she would “put to the vote all requests for postponement”, a decision that led to the appreciation of the deputies and that was unanimously approved.
