Popular video platform TikTok is suing the US government, CNBC reports. The lawsuit comes after Joe Biden signed legislation in April that would force Chinese owners to sell the app. Otherwise, TikTok will be banned in the US. The company is now suing.

TikTok invokes freedom of expression

As a result, the US government is restricting freedom of speech through the new law. In a press release, the platform says this violates the First Amendment of the US Constitution.

The US government has been working to ban TikTok for years. The Trump administration already wanted to take the app offline. The federal government has already banned TikTok on government devices. According to CNBC, Republican and Democratic politicians are concerned that Tiktok's parent company, ByteDance, is sending Americans' data to the Chinese government.

TikTok demands proof of US government security concerns

TikTok maintains that security concerns are not enough to limit free speech. The US government must prove that the ban is justified. The law would also set a precedent and allow other platforms and applications to be banned as well.

Lawsuit could delay ban

The lawsuit before the Washington appeals court could delay the ban of TikTok in the US for years, the Tagesschau reports. The US government had given ByteDance a deadline that gave the company more than a year to sell TikTok.

But for the Chinese company, selling is out of the question. The company made this clear in the statement of claim. He says: “There is no doubt: the law will force TikTok to close on January 19, 2025.”
